Terms of Use
1. These terms
These Terms of Use are a contract between you and Skypointe Limited (trading as Kynaris) for Kynaris KT Viewer. By ticking that you agree on the splash screen, you accept these terms. If you do not agree, do not use the app.
The Privacy Notice explains how we process information about you as a user. Map and library credits are on the Data and licences page.
2. The trial
Kynaris KT Viewer is a 2D live-traffic demonstration viewer offered as a partner trial. It is provided free of charge, as-is, for evaluation, testing, and review only. It is not an operational system and it is not licensed as a navigation, surveillance, or safety product.
3. Permitted use
You may use the app only to evaluate Kynaris’s demonstration of live traffic visualisation.
You must not use it for any operational, navigational, air-traffic, piloting, or safety-critical purpose, or to control an aircraft or vehicle. Positions, altitudes, and maps may be incomplete, delayed, or wrong. Do not rely on them.
You must not attempt to disrupt the service, probe it except as we invite in the trial, scrape it as a data feed, or use it to break the law.
4. Age
You must be 13 or older to use the app, unless a parent or guardian agrees to these terms on your behalf. By agreeing, you confirm that you meet that requirement or that a parent or guardian is agreeing for you.
5. Your device
Use requires strictly necessary storage on your device, described in the Privacy Notice. You accept that storage on the splash screen. The app needs a network connection. Your device and network charges are yours.
6. Maps and third parties
Street maps for this trial use OpenStreetMap data (ODbL). The default tiles are served through our own raster service.
CARTO street maps are optional. If you select them, your browser requests tiles from CARTO and you must comply with CARTO’s basemap terms, including attribution. Any access key we supply for those requests is not yours to reuse elsewhere.
The app also loads mapping libraries from public CDNs. Their terms apply to those files.
7. Your content
This app does not provide a file-upload feature. Do not attempt to inject or host content through it.
8. Our content
The app, branding, and layout are owned by Skypointe Limited or its licensors. Third-party maps and libraries remain subject to their own licences (see Data and licences). You get a limited, revocable right to use the app during the trial, not ownership.
9. Availability
We may change, suspend, or end the trial at any time, without notice and without liability, as far as applicable law allows.
10. Liability
The app is a free trial. It is provided without warranties, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent UK law allows.
We are not liable for any loss arising from use or inability to use the app, including loss of data, profit, or business, or any indirect or consequential loss, except where UK law says we cannot exclude or limit that liability.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that UK law does not allow us to exclude or limit.
If we are liable to you in spite of this section, our total liability in connection with the trial is limited to £100, except where that cap is not permitted by law.
11. Ending use
You may stop using the app at any time. We may end your access at any time. Sections that by nature should survive (including 3, 8, 10, and 12) continue to apply.
12. Law
These terms are governed by the laws of England and Wales. The the courts of England and Wales have exclusive jurisdiction, except that we may still apply for an injunction in any jurisdiction.
If a court finds any part unenforceable, the rest remains in effect.
